Terms of Use

Banny App is an educational and motivational tool. We are NOT medical professionals, and Banny is NOT a medical device, does NOT provide medical advice, diagnosis, or treatment, and is NOT a substitute for professional medical care. The information provided by the App, the Site, and the in-app AI coach is for general informational and motivational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you have read or received through the Service. If you may be experiencing a medical or mental-health emergency, contact your local emergency services immediately.

1. Acceptance of Terms

These Terms of Use (the "Terms") form a legally binding agreement between you and Banny App ("Banny", "we", "us", or "our") and govern your access to and use of the Banny mobile application, the website at banny.app, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. The Service is intended for personal, non-commercial use only.

3. The Service

Banny is a health and wellness recovery companion that provides a personalized, self-guided program, progress tracking, gamification, and an in-app AI coach for educational and motivational purposes. The Service does not establish a doctor-patient, therapist-client, or other professional relationship, and the AI coach generates automated responses that may be inaccurate or incomplete and must not be relied upon as professional advice. The AI coach is powered by a third-party large language model (Google Gemini); when you use it, the content of your messages and a snapshot of your recovery context are transmitted off your device to our backend and to Google for processing, as described in our Privacy Policy.

4. Not Medical Advice; Assumption of Risk

You acknowledge and agree that the Service is not a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment. You are solely responsible for evaluating the suitability of any information or activity and for any decisions or actions you take based on the Service. You use the Service voluntarily and assume all associated risks. Consult a qualified professional before making changes that may affect your health.

5. Accounts & Your Responsibilities

The Service uses an anonymous sign-in and does not require you to create an account with an email address, phone number, or password. You are responsible for maintaining control of the device on which the Service is installed and for all activity that occurs through the Service on your device. Most of your data is stored only on your device; you are responsible for safeguarding that device and for any backups. You agree to provide accurate information during the assessment so the Service can function as intended.

6. Subscriptions, Billing & Cancellation

Certain features of the Service require a paid subscription ("Premium"). The following terms apply to all purchases:

  • Processing. All payments are processed by the Apple App Store or Google Play Store through their in-app purchase systems and are managed via RevenueCat. Banny does not collect, receive, or store your payment card information.
  • Pricing & plans. Subscription options (which may include weekly, monthly, and multi-month plans) and pricing are presented in the App at the point of purchase and may change over time. Applicable taxes may apply.
  • Free trials. If a free trial is offered, unless you cancel before the trial ends, the subscription will automatically convert to a paid subscription and you will be charged.
  • Auto-renewal. Subscriptions automatically renew for successive periods at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within the period specified by the app store.
  • Cancellation. You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings, or via the in-app subscription-management screen. Cancellation takes effect at the end of the current billing period.
  • Refunds. Purchases are generally non-refundable except where required by law. Refund requests are handled by Apple or Google in accordance with their applicable policies, not by Banny.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose;
  • Reverse engineer, decompile, tamper with, or attempt to bypass any security or subscription mechanism of the Service;
  • Copy, modify, distribute, sell, sublicense, or create derivative works from the Service or its content except as expressly permitted;
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
  • Use automated means to access the Service or scrape its content without our prior written consent.

8. Intellectual Property & License

The Service, including its software, content, design, text, graphics, and trademarks, is owned by Banny or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own non-commercial use. All rights not expressly granted are reserved.

9. Your Content

Content you generate within the Service — such as assessment answers, journal and setback entries, and the saved record of your AI coach conversations — is stored on your device, as described in our Privacy Policy. With one important exception: when you use the AI coach, the content of your messages and a snapshot of your recovery context are transmitted to our backend and to a third-party AI provider (Google Gemini) to generate responses. You should not submit information to the AI coach that you do not want transmitted to or processed by a third-party AI service. You are solely responsible for the content you provide and for retaining any copies you wish to keep, since on-device content is removed if you delete or reset the App.

10. Third-Party Services

The Service relies on third parties including Apple, Google, Supabase, RevenueCat, PostHog, Firebase (Analytics/Crashlytics), and Google Gemini (which powers AI coach responses and processes the inputs you send to the coach). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices, availability, or content of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY RESULTS OR RECOVERY OUTCOMES WILL BE ACHIEVED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BANNY OR ITS OWNERS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Banny and its owners, officers, employees, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or to protect the Service. You may stop using the Service at any time and may delete your anonymous account and uninstall the App. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Changes to the Service or Terms

We may modify or discontinue all or part of the Service, and we may update these Terms from time to time. When we update the Terms, we will revise the "Last Updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which the operator of Banny is established, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the competent courts of that jurisdiction for any dispute not subject to mandatory arbitration or small-claims resolution, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence. Before initiating any formal proceeding, you agree to first contact us in good faith to attempt to resolve the dispute informally.

17. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Banny regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms do not create any third-party beneficiary rights, except that Apple and Google are intended third-party beneficiaries of the app-store-related provisions.
